FAIRFIELD PRIVACY NOTICE

Fairfield and its respective subsidiaries and affiliates (“Fairfield”, “Company”, “we”, “us” or “our”) respects your privacy and is committed to protecting your information. This Privacy Notice applies to our websites, including fairfieldresidential.com and any other website or mobile app that links to this Notice. This Privacy Notice also describes our other interactions with you in which we provide you with a link to this Privacy Notice, such as when you fill out a rental application or job application. The services that we may provide to you that are subject to this Privacy Notice are referred to below as our “Service.” Please read this notice carefully to understand how your personal information is collected, used and disclosed by the Company in connection with our Service.

WHAT INFORMATION DO WE COLLECT AND FOR WHAT PURPOSE?

Information we collect directly from or about you: We collect personal information, such as your name, address, phone number, location, and email address when you sign up for our mailing list, provide a comment or ask us a question, schedule a property tour, or otherwise communicate with us.

We may collect additional information if you fill out an apartment or job application, which could include your name, date of birth, driver’s license, passport or other photo ID, professional and employment information, and other information necessary to evaluate your application, communicate with you, and comply with our legal and regulatory obligations. For example, in certain instances we may be required to obtain information about your income, disability and other protected classifications in order to determine your eligibility for certain programs and comply with legal obligations.

If you are a resident of one of our properties, we may collect additional information from you, such as security camera footage, resident portal profile information, and information regarding your rent payments, insurance coverage, vehicle make, model and license plate, utilities usage, package delivery and locker usage, use of “smart” keys, IoT devices and other building amenities (if applicable).

If you fill out a job application, we will collect your name, email address, phone number and other contact information as well as information about your professional and educational background. We use this information to evaluate your eligibility and to communicate with you.

We may also collect any communications between you and Company and any other information you provide to Company, and information and user content you submit in online portals or chats, such as in an online marketplace on one of our resident portals. If you call us by phone, we may record the conversation for quality assurance or other purposes described in this Privacy Notice.

We may process personal information about you that is sensitive in nature and is subject to special protection under applicable law. This information may include information relating to racial and ethnic origin, mental or physical health diagnosis, citizenship or immigration status, and precise geolocation. We process this personal data for a variety of reasons as described in this Privacy Notice.

We may also receive information about you from our third party partners, for example, vendors we use to provide background checks, credit screens, fraud detection, payment processing services, property management services, and similar third parties. We may also receive information from any third party you direct to share information with us.

We use the information described above to operate, maintain, and provide to you the features and functionality of the Service, as well as to respond to your requests, send you Service-related notices, and marketing communications.

If you choose not to provide certain information, we may not be able to provide certain services or process certain requests.

Information collected automatically from our online services: We and our third party service providers may collect certain types of usage information when you visit our websites or access our Service, read our emails, or otherwise engage with us. We may use this information to enhance and personalize your user experience, to monitor and improve our websites and services, and for other similar purposes. In some instances, we and our third party service providers may combine this usage information with the personal information described above.

We and our third party partners use tracking technologies, including cookies, web beacons, embedded scripts, location-identifying technologies, file information, and similar technology, to automatically collect usage and device information, including information about your device and its software (such as IP address, browser type, Internet service provider, device type/model/manufacturer, operating system, date and time stamp, and a unique device ID); information about the way you access and use our Service (referral and exit information, the pages visit or links you click, whether you open emails or click the links contained in emails, whether you access the Service from multiple devices); information about your location (including GPS or we may infer your location based on IP address or other information). We may also work with third party partners to employ technologies, including the application of statistical modeling tools that permit us to recognize and contact you across multiple devices. We may collect analytics data or use third party analytics tools such as Google Analytics to help us measure traffic and usage trends for the Sites and to understand more about the demographics of our users. We use or may use the data collected through tracking technologies to: (a) remember information so that you will not have to re-enter it during your visit or the next time you visit the site; (b) provide custom, personalized content and information, including targeted content and advertising; (c) recognize and contact you across multiple devices; (d) provide and monitor the effectiveness of our Service; (e) monitor aggregate metrics such as total number of visitors, traffic, usage, and demographic patterns on our Service; (f) diagnose or fix technology problems; and (g) otherwise to plan for and enhance our Service.

If you would prefer not to accept cookies, most browsers will allow you to: (i) change your browser settings to notify you when you receive a cookie, which lets you choose whether or not to accept it; (ii) disable existing cookies; or (iii) set your browser to automatically reject cookies; however, doing so may negatively impact your experience using the Service, as some features and services on our Service may not work properly. You may also set your email options to prevent the automatic downloading of images that may contain technologies that would allow us to know whether you have accessed our email and performed certain functions with it.

HOW DO WE SHARE YOUR INFORMATION?

We may share your personal information with:

  • Other subsidiary and affiliate companies and brands including but not limited to Fairfield Residential Company, LLC and FF Properties L.P., a Delaware limited partnership, registered in California as Fairfield Properties L.P. These companies will use your personal information in the same way as we can under this Privacy Notice.

  • Vendors and other service providers that perform services on our behalf, as needed to carry out their work for us, which may include providing mailing services, providing tax and accounting services, providing analytic services or marketing services, and providing resident management services. For example, we use Yardi Systems to host our resident portal.

  • Third-party vendors as necessary to fulfil our legal and regulatory obligations and facilitate our business operations, such as our property managers, payment processors and banking institutions to process payments, vendors that provide credit checks or recommendations on whether you qualify to rent an apartment, identity verification or background check providers and similar services.

  • Vendors and other service providers we work with to provide additional services to you, such as rewards program providers or moving services. For example, we may work with resident rewards platforms such as Rentgrata to connect current and prospective residents, and we may work with moving platform service providers such as Updater to facilitate the move-in and move-out process for residents. If you choose to create an account with one of these partners directly, they may use your personal information according to their own privacy policies and practices.

  • Other parties in connection with a company transaction, such as a merger, sale of company assets or shares, reorganization, financing, change of control or acquisition of all or a portion of our business by another company or third party, or in the event of a bankruptcy or related or similar proceedings.

  • Third parties as required by law or subpoena or if we reasonably believe that such action is necessary to (a) comply with the law and the reasonable requests of law enforcement; (b) to enforce our contractual rights or to protect the security or integrity of our Service; and/or (c) to exercise or protect the rights, property, or personal safety of Company, our visitors, or others.

We may also share information with others in an aggregated or otherwise anonymized form that does not reasonably identify you directly as an individual.

CONTROL OVER YOUR PERSONAL INFORMATION

How to control your communications preferences. You can stop receiving promotional email communications from us by clicking on the “unsubscribe link” provided in such communications. We make every effort to promptly process all unsubscribe requests. You may not opt out of service-related communications (e.g., account verification, transactional communications, changes/updates to features of the Service, technical and security notices).

Modifying or deleting your information. If you have any questions about accessing, modifying, or deleting your information, or if you want to remove your name or comments from our Service or publicly displayed content, you can use our rights request form. We may not be able to modify or delete your information in all circumstances.

THIRD PARTY TRACKING AND ONLINE ADVERTISING

We participate in interest-based advertising and use third party advertising companies to serve you targeted advertisements based on your online browsing history and your interests. We permit third party online advertising networks, social media companies, and other third party services to collect information about your visits to our Service over time so that they may play or display ads on our websites, on other websites, apps, or services you may use, and on other devices you may use. Typically, though not always, the information used for interest-based advertising is collected through cookies or similar tracking technologies. We may share a common account identifier (such as an email address or user ID) or hashed data with our third party advertising partners to help identify you across devices. We and our third party partners use this information to make the advertisements you see online more relevant to your interests, as well as to provide advertising-related services such as reporting, attribution, analytics, and market research.

We may also utilize certain forms of display advertising and other advanced features through Google Analytics, such as Remarketing with Google Analytics, Google Display Network Impression Reporting, and Google Analytics Demographics and Interest Reporting. These features enable us to use first-party cookies (such as the Google Analytics cookie) and third party cookies (such as the DoubleClick advertising cookie) or other third party cookies together to inform, optimize, and display ads based on your past visits to the Sites. Fairfield provides services exclusively within the United States (“U.S.”) and does not own or manage property outside the U.S., intentionally market its services extraterritorially, or have a presence outside the United States, including in the European Union (“EU”), any EU-Member State, or any state belonging to the European Economic Area (“EEA”). If you choose to use our Service from the European Union or other regions of the world with laws governing data collection and use that differ from United States law, please note that we will transfer information, including personal information, to a country and jurisdiction that does not have the same data protection laws as your jurisdiction.

LINKS TO OTHER WEBSITES

The website may contain links to other websites that are not owned or controlled by Fairfield. We are not responsible for the privacy practices of such other websites and we cannot warrant that these websites are secure. If you have concerns regarding privacy practices of other websites, you should read the specific privacy policies posted on these websites when linking to them.

MODIFICATIONS TO THE PRIVACY NOTICE

We reserve the right to modify this Privacy Notice at any time, so please review it frequently. If we decide to change our Privacy Notice, we will post those changes on the website so our users and investors are always aware of what information we collect, use and disclose. When we change the Privacy Notice in a material manner, we will let you know and update the ‘last modified’ date at the bottom of this page. If you object to any changes, you may close your account. Continuing to use our Service after we publish changes to this Privacy Notice means that you are consenting to the changes

  • Right to correction. You may have the right to correct inaccuracies in your personal information, taking into account the nature of the personal information and the purposes of the processing of your personal information.

  • Right to deletion. You may have the right, in some circumstances, to require us to delete your personal information.

  • Right to opt-out. You may have the right to opt-out of certain processing activities. For example, you may have the right to opt-out of the use of your personal information for targeted advertising purposes, to “sell” or “share” your personal information with third parties in certain contexts, or for profiling in furtherance of decisions that produce legal or similarly significant effects.

Before processing your request, we will need to verify your identity and confirm you are a resident of the Virginia, which may require us to request additional personal information from you or require you to log into your account, if you have one. In certain circumstances, we may decline or limit your request, particularly where we are unable to verify your identity or locate your information in our systems, or as permitted by law.

To Exercise Your Virginia Opt-Out Right

Unless you have exercised your Right to Opt-Out, we may disclose or “sell” your personal information to third parties for monetary or other valuable consideration, or use your information for all the purposes described in this Privacy Notice, including for targeted advertising and certain profiling activities. The third parties to whom we sell personal information may use such information for their own purposes in accordance with their own privacy policies.

You do not need to create an account with us to exercise your Right to Opt-Out. However, we may ask you to provide additional personal information so that we can properly identify you to track compliance with your opt-out request. We will only use personal information provided in an opt-out request to review and comply with the request. If you choose not to provide this information, we may only be able to process your request to the extent we are able to identify you in our data systems. We may not process your request if we, in good faith, believe that the request is fraudulent. In such instances, we will send a notice to the requestor explaining our decision.
